Update: The judge dropped the lawsuit for Nirvana on Monday, January. 3.

Plaintiffs who comprise Universal Music Group and The David Geffen Company have requested dismissal of the lawsuit the day of Dec. 22. As Plaintiff Spencer Elden had not filed any objection to the motion before the December. 30 date, a judge approved the dismissal.

But it was “dismissed with the right for amendment” and Elden has until January. 13 , to submit a second amended Complaint.

In a statement made to E! News Elden’s lawyer stated that his team plans to keep working on the child pornography matter. “In conformity of the court’s decision, we will file an amended Second Complaint within the next few days,” the lawyer said. “We are hopeful of the fact that Spencer will be granted permission to proceed in the matter.”

Instead of making a hit and a flop, the Nirvana members Nirvana are now facing a lawsuit to their name.

On August. 24 the man who was photographed naked as a newborn for the legendary cover of the 1991 Nevermind album’s cover, filed a lawsuit claiming that he was the subject of pornographic child images.
